Executive Summary
- Scope: These Terms govern all use of ebotnote.com (the “Site”) and its services (publishing, hosting, downloading, sharing of whitepapers). They apply to visitors (unregistered users), registered users (readers/downloaders), contributors/authors (who submit whitepapers), and administrators.
- Account Eligibility: Users must be at least 13 years old (or the minimum legal age in their jurisdiction). Accounts are personal (non-transferable) and must use accurate information. We may require additional verification for certain features.
- User Content: Users retain ownership of their uploaded whitepapers. By submitting or uploading (“Posting”) content, users grant eWhitepaper a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, and display that content on the Site and affiliated services (in all current and future media). This license ends when the content is removed (unless others have downloaded or shared it). All user content must comply with applicable laws and our content policies; eWhitepaper reserves the right to remove or disable any content that violates copyrights or other rules (including material alleged to be infringing).
- Copyright & DMCA: eWhitepaper follows the DMCA safe-harbor process. We designate an agent to receive takedown notices (see Contact below). If we receive a compliant DMCA takedown notice alleging infringement, we will expeditiously remove or disable access to the material. We will promptly notify the user who posted the material and allow the user to submit a counter-notice if they believe the removal was mistaken. Upon receiving a valid counter-notice, we will restore the material within 10–14 business days unless the original notifier files a court action. - Moderation & Takedowns: Users agree that eWhitepaper and its administrators may monitor, review, and remove user content or terminate user accounts at our discretion for violations of law or these Terms. Repeat infringers will have accounts terminated. We do not pre-screen all content, but we reserve the right to do so, and to refuse service or access to anyone for any reason.
- No Warranties: All Site content and services are provided “as is” and “as available,” without any warranties. eWhitepaper makes no guarantees about accuracy, uptime, security, or that the Site will meet any particular requirements. We disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement, etc.).
- Limitation of Liability: To the fullest extent permitted by law, eWhitepaper and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of use of the Site, including loss of data, profits, or goodwill. Our total liability for any claim will not exceed the greater of $100 or the amount paid by the user to eWhitepaper in the past 12 months (if applicable), except where prohibited by law. We are not liable for user-submitted content or third-party links.
- Indemnification: Users agree to indemnify and hold harmless eWhitepaper, its officers, agents, and employees from any claims arising out of their use of the Site or violation of these Terms (including infringement of third-party rights).
- Termination: These Terms remain effective until terminated. We or the user may terminate an account at any time. Upon termination of a user’s access (for any reason), all licenses granted to that user terminate immediately and the user must cease all use of the Site content. Sections concerning ownership, disclaimers, liability limits, indemnity, and governing law survive termination.
- Governing Law & Jurisdiction: No specific jurisdiction is pre-selected. If legal action arises, it will be brought in an appropriate court, but we do not guarantee any particular forum or law will apply. We may clarify governing law in the future, but currently no jurisdiction is specified.
- Changes to Terms: eWhitepaper may revise these Terms at any time. For material changes, we will post notice on the Site or notify registered users (e.g. by email) with at least 30 days’ notice. Continued use of the Site after changes are posted constitutes acceptance of the new Terms.
- Privacy Policy: Use of the Site is also governed by our Privacy Policy (linked on the Site). By agreeing to these Terms, you agree that we may collect and use data as described therein.

1. Acceptance of Terms
By accessing or using eWhitepaper.net, you agree to these Terms and Conditions. If you do not agree, do not use the Site. We may modify or discontinue the Site (or features) at any time without notice (see Changes to Terms).
2. Use of the Site
- Eligibility: You must meet the eligibility criteria above (age 13+) to use the Site. Accounts registered by bots or on behalf of others are prohibited. One account per person is allowed (plus machine accounts for automated use).
- Registration: Certain features (e.g., uploading or downloading content) require registration. You must provide a valid email and keep your contact info up-to-date. You are responsible for all activity under your account, and for protecting your password. Notify us immediately of any unauthorized use. eWhitepaper is not liable for security breaches due to your failure to safeguard your account.
3. Roles and Accounts
- Visitors: Can browse and read any whitepapers marked public, but cannot upload or download.
- Registered Users (Readers): Can download or bookmark available whitepapers (in accordance with license terms of those papers).
- Authors/Contributors: Can upload and publish whitepapers. When uploading, you represent that you have the rights to the content you submit. Each whitepaper must be properly formatted and free of malware or illegal content. We may require authors to verify authorship (e.g., institutional email).
- Administrators/Moderators: eWhitepaper staff have the right to review, edit metadata, and remove any user content. They do not claim ownership of user works, but may edit for compliance.
4. User Content Ownership and License
- Ownership: You retain all ownership rights to any content (whitepapers, summaries, comments, etc.) that you submit to the Site. eWhitepaper does not claim ownership of user content.
- License to eWhitepaper: By uploading or posting content on the Site, you grant eWhitepaper a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your content in connection with the Site’s operation. This includes sublicensing to our service providers, hosting sites, and affiliates. The license covers all forms of media now known or hereafter developed, solely for purposes of operating and improving eWhitepaper (for example, storing backups, displaying your paper in search, translating summaries, etc.).
- License to Other Users: If you post a whitepaper publicly, other users may download and share it under the terms you specify (we encourage Creative Commons or similar licenses). You may also choose to allow public reading without download. When you make content public, you implicitly allow others to view and share it according to Site features (similar to GitHub’s “fork” model).
- Duration: The above license to eWhitepaper ends if you remove your content (unless others have already downloaded or licensed it independently). eWhitepaper will stop displaying removed content “in a reasonable amount of time” after removal.
- Digital Millennium Copyright Act (DMCA): eWhitepaper complies with U.S. and international copyright laws. If you believe any content infringes your copyright, see the Copyright & DMCA section below for our notice procedure.
5. User Conduct and Content Policies
- Lawful Use: You agree not to use the Site to engage in illegal activities or violate anyone’s rights (privacy, publicity, intellectual property, etc.). You may not impersonate others or misrepresent your affiliation.
- Prohibited Content: You may not upload or share content that is defamatory, obscene, infringing, pornographic, violent, or in any way harmful or unlawful. We prohibit discriminatory or hate content and content that facilitates wrongdoing (fraud, hacking, etc.).
- Content Moderation: eWhitepaper reserves the right to remove any content at our discretion (for violations of law, DMCA, or these Terms). We follow a notice-and-takedown system: upon receiving a valid complaint of infringement, we will disable the content. We do not monitor all uploads, but may do so or use automated tools to detect viruses or illegal content.
- Repeat Infringers: We will terminate the accounts of users who repeatedly infringe copyrights or other rights.
6. Copyright and DMCA Procedures
- Copyright Notices: If you own copyrighted material and find it on our Site without permission, send a written DMCA takedown notice to our designated agent (see Contact below). - Counter-Notices: If your content was removed and you believe it was a mistake, you may send a counter-notice. The counter-notice must include: (i) your signature; (ii) identification of the removed material and its prior location; (iii) a statement under penalty of perjury that you have a good faith belief of mistake or misidentification; (iv) your contact info; and (v) consent to jurisdiction of U.S. federal court in your district (or the district where our agent is located). Upon a valid counter-notice, we will restore the content within 10–14 business days unless the complainant notifies us of court action. Example templates are below.
- Repeat DMCA Violations: Uploading content knowing it infringes someone else’s copyright is grounds for immediate account termination.
7. Third-Party Content, Links, Advertising, and Analytics
- Third-Party Content: The Site may include links to external sites (papers on publisher platforms, reference links, ads). We do not control third-party content and are not responsible for it. Links to external sites are provided for convenience only.
- Advertising: eWhitepaper may display advertisements or sponsorships. Advertisers’ content is not endorsed by eWhitepaper. Any transaction or correspondence with advertisers is solely between you and the advertiser.
- APIs: If eWhitepaper provides an API for programmatic access, you must comply with the API terms. Unauthorized harvesting, scraping, or circumventing rate limits is prohibited. API keys/account info must be kept secure.
- Analytics: We and third-party analytics providers (e.g. Google Analytics) may collect anonymized usage data (pages viewed, downloads, etc.) to analyze traffic and improve services. This is described in our Privacy Policy.
8. Disclaimers of Warranties

9. Limitation of Liability

We may take control of any defense or settlement, and you must cooperate and pay legal costs as described in similar platform policies.
11. Termination
eWhitepaper may suspend or terminate your access at any time, with or without cause or notice. For example, violation of these Terms (including repeat infringement) will result in termination. You may also cancel your account by contacting us. Upon termination, you must stop using the Site immediately, and all licenses granted under these Terms will cease. However, provisions concerning content ownership, disclaimers, limitations of liability, indemnity, and governing law will survive.
12. Governing Law and Jurisdiction
No specific governing law is chosen at this time. Any dispute will be handled in the applicable court without exclusive jurisdiction. If at a later date we specify a jurisdiction, we will amend these Terms accordingly. Users outside that jurisdiction are subject to the laws of their own country.
13. Changes to Terms
We reserve the right to amend these Terms at any time (for example, to add new features or comply with law). We will post notice of significant changes on the Site or via email at least 30 days in advance. If the changes are material, we will highlight them. Your continued use of the Site after changes are posted constitutes acceptance.
